Man Arrested for DWI and Flee to Elude after Failing to Stop at Checking Station

On Saturday April 15, 2023, Officers with the Morganton Department of Public Safety were conducting a motor vehicle checking station on Lenoir Road near Walter Johnson Middle School. At approximately 10:45pm, Dezmon Ke-von Witherspoon, 35, of Lincolnton came through the checking station and failed to stop for Public Safety Officers. Witherspoon then attempted to flee from officers at a high rate of speed. Officers proceeded to pursue Witherspoon for a short distance resulting in a vehicle chase. Witherspoon surrendered near Sanford Drive and was taken into custody. Witherspoon was charged with the following offenses:

  • Felony Flee to Elude in a Motor Vehicle
  • Driving While Impaired
  • Reckless Driving to Endanger
  • Speeding
  • Possess Open Container in Passenger Area

Witherspoon received a $5,000 secured bond with a first appearance scheduled for April 17, 2023 at 09:00am. Witherspoon’s vehicle was seized as a result of the “Run and You’re Done” Law.
